1. Introduction and Acceptance

VEVA Investments LLC d/b/a Awesome Renovations ("Awesome Renovations," "we," "us," or "our") is a licensed residential renovation company serving the DFW area. We operate at awesomerenovations.ttscontractors.com (the "Site"). These Terms of Service ("Terms") govern your access to and use of the Site and any services we offer through it.

We may update these Terms. Material changes take effect 30 days after posting via email or on-site notice. Continued use constitutes acceptance.

2. Website Description and Scope

This Site is the online presence of Awesome Renovations, a residential renovation company. The Site provides information about our services (kitchens, bathrooms, and interior renovations), testimonials, contact information, and a chat widget that allows prospective clients to inquire about projects.

The Site is intended solely for individuals who are 18 years of age or older. By using the Site, you represent that you are at least 18 years old. If you are under 18, you must immediately cease use.

Awesome Renovations performs renovation work directly and does not operate as a referral marketplace or platform. All project relationships are between you and Awesome Renovations (VEVA Investments LLC).

3. User Terms

License Grant

Subject to these Terms and our Privacy Policy, Awesome Renovations grants you a limited, non-exclusive, non-transferable license to use the Site for your personal, non-commercial use strictly in accordance with these Terms.

You may reach us through the chat widget on this Site, by phone at 817-883-0387, or by email at [email protected]. Submitting a project inquiry does not create a contract for services. A separate written agreement is required before any work begins.

License Restrictions

You shall not:

• Use the Site for any illegal purpose or in violation of any local, state, national, or international law;
• Copy, modify, adapt, translate, or create derivative works from any portion of the Site;
• Reverse engineer, disassemble, or otherwise attempt to derive the source code of the Site;
• Remove, delete, or obscure any copyright, trademark, or other proprietary rights notices;
• Rent, lease, sell, sublicense, or otherwise make the Site available to third parties for commercial purposes;
• Use automated tools to scrape or collect data from any page of the Site;
• Create a false identity or misrepresent your identity on the Site;
• Impersonate Awesome Renovations, its employees, or any other person or entity;
• Engage in conduct that restricts or inhibits any other person's use of the Site; or
• Use the Site in any way that could harm minors.

Awesome Renovations reserves the right to prohibit any current or future use of the Site for violations of these Terms and to cooperate with law enforcement as necessary.

Reservation of Rights

The Site is provided under license, not sold. You do not acquire any ownership interest in the Site under these Terms. Awesome Renovations and its licensors and service providers reserve all rights, title, and interest in and to the Site, including all copyrights, trademarks, and other intellectual property rights, except as expressly granted herein.

Content

Through the Site, Awesome Renovations may make accessible various content including videos, photographs, images, text, and other materials (collectively, "Content"). You have no rights in or to the Content other than as permitted herein to use or access the Site.

You retain your rights to any content you submit through the Site ("User Content"). By submitting User Content, you grant Awesome Renovations a non-exclusive, royalty-free license to display and use that content in connection with operating the Site and our business.

4. Data Collection and Usage

All data collection, use, and sharing practices are governed by our Privacy Policy.

What We Collect

How It Is Used

Information you provide is used solely to evaluate and respond to your renovation inquiry, to contact you about your project, to send you a post-project review invitation, and to improve the Site. Awesome Renovations will not sell your data or share it with unrelated third parties.

Awesome Renovations employees have access to inquiry data for operations. Aggregate, de-identified data may be used for business analysis.

5. Geographic Restrictions

The Site and services are intended for residents of the Dallas-Fort Worth metro area and surrounding Texas communities. Awesome Renovations operates primarily in Mansfield, Arlington, Ft. Worth, Keller, Southlake, and the greater DFW region. If you access the Site from outside our service area, we may not be able to serve you, and you are responsible for compliance with local laws.

6. Third-Party Materials

The Site may display or link to third-party content, websites, or services ("Third-Party Materials"). Awesome Renovations is not responsible for Third-Party Materials, including their accuracy, completeness, legality, or quality, and assumes no liability for them. Third-Party Materials are provided for convenience and you access them at your own risk.

7. Communications and Consent

General Contact

By submitting an inquiry through our Site's chat widget, you consent to: a confirmation communication from Awesome Renovations acknowledging receipt; follow-up contact from our team by phone, email, or text to discuss your project; and a post-project review invitation.

SMS Messaging

Marketing

Marketing messages (newsletters, promotions) require a separate opt-in. Submitting a project inquiry does not opt you into marketing communications. All emails include an unsubscribe link, our physical address, and accurate sender information.

8. Intellectual Property

The Site's design, branding, content, software, and technology are the property of Awesome Renovations (VEVA Investments LLC). You are granted a limited license to use the Site as described herein. You shall not engage in scraping, automated data collection, redistribution of Site content, unauthorized use of Awesome Renovations trademarks, or reverse engineering of any part of the Site.

You retain ownership of reviews you submit and grant Awesome Renovations a non-exclusive, perpetual, royalty-free license to display and use your review. This license terminates upon a valid removal request.

9. Reviews and Feedback

Awesome Renovations does not suppress, manipulate, or incentivize reviews. Reviews may be removed only if they contain verifiably false statements, hate speech, threats, private personal information, or violations of these Terms. You may request removal of your own review by contacting [email protected] (processed within 15 business days). Awesome Renovations may use aggregate review data in marketing without identifying individuals.

10. Disclaimers and Limitations of Liability

THE SITE IS PROVIDED "AS IS" AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, AWESOME RENOVATIONS EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, WITH RESPECT TO THE SITE, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Awesome Renovations does not guarantee: project timelines, costs, or outcomes beyond what is stated in a written agreement; uninterrupted Site availability; or the accuracy of third-party content displayed on the Site.

LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AWESOME RENOVATIONS, ITS DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY LOST PROFITS, DATA LOSS, SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR FOR DIRECT DAMAGES IN EXCESS OF ONE HUNDRED U.S. DOLLARS ($100.00). SOME STATES DO NOT ALLOW EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify Awesome Renovations and its officers, directors, employees, and affiliates from claims arising from your use or misuse of the Site, content you submit, and any violation of these Terms or applicable law; provided, however, that this obligation shall not apply to the extent any claim arises from Awesome Renovations' own gross negligence or willful misconduct.

12. Dispute Resolution

All disputes arising out of or related to these Terms or the Site shall be resolved through binding arbitration administered by JAMS under the JAMS Consumer Minimum Standards. Arbitration is conducted on an individual basis. Class actions and class arbitrations are waived. Arbitration shall take place in Tarrant County, Texas.

Governing law: Texas. Jurisdiction: State or federal courts in Tarrant County, Texas.

You may bring an individual claim in small claims court in the county of your residence if the claim qualifies under applicable small claims court rules.

13. Termination

By you: Stop using the Site at any time. Data deletion requests are processed within 30 days, subject to legal retention requirements.

By Awesome Renovations: We may restrict access to the Site for Terms violations, fraud, or harmful conduct. Notice will be provided except in cases of fraud or safety emergencies.

14. General Provisions

Severability: If any provision of these Terms is unenforceable, the remainder will be amended to achieve as closely as possible the effect of the original, and all other provisions continue in full force.

Assignment: Awesome Renovations may assign these Terms to a successor; you may not assign without our express written consent.

Force majeure: Awesome Renovations is not liable for delays or failures beyond our reasonable control.

Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Awesome Renovations with respect to the Site and supersede all prior or contemporaneous understandings.

Waiver: No failure to exercise any right hereunder shall operate as a waiver, nor shall any single exercise preclude further exercise of any right.
